Is a California lien waiver legally binding once signed?
Yes. A California lien waiver takes effect based on Civil Code §§8132–8138. An unconditional waiver is binding the moment you sign — even if payment never clears. A conditional waiver only takes effect once the paying party's check actually clears. Signing the wrong form before payment can waive your lien rights permanently.
What is the difference between a conditional and unconditional lien waiver?
A conditional waiver takes effect only after payment clears. An unconditional waiver takes effect immediately on signature, regardless of whether payment arrives. Contractors should never sign an unconditional waiver before payment clears. PaidWrite flags this automatically.
Does PaidWrite work for contractors outside California?
Lien waiver analysis is California-specific (Civil Code §§8132–8138). W-9 analysis is federal and applies anywhere in the US. ACORD 25 Certificate of Insurance analysis and OSHA Safety Data Sheet analysis are nationally applicable. Other state lien waiver rulesets are on the roadmap.
How accurate is the analysis?
